THISLIMITEDWARRANTY("WARRANTY")APPLIESTOTHEPRODUCTS(ASDEFINEDBELOW)OF
SYNOLOGY,INC.ANDITSAFFILIATES,INCLUDINGSYNOLOGYAMERICACORP,(COLLECTIVELY,
"SYNOLOGY").YOUACCEPTANDAGREETOBEBOUNDBYTHETERMSOFTHISWARRANTYBY
OPENINGTHEPACKAGECONTAININGAND/ORUSINGTHEPRODUCT.IFYOUDONOTAGREETO
THETERMSOFTHISWARRANTY,DONOTUSETHEPRODUCT.INSTEAD,YOUMAYRETURNTHE
PRODUCTTOTHERESELLERWHEREYOUPURCHASEDITFORAREFUNDINACCORDANCEWITH
THERESELLER'SAPPLICABLERETURNPOLICY.
Section 1. Definitions.
(a) "New Product",

all DS/RS NAS models with the XS+/XS suffix
(exceptR)inorafter13-series,andall
DX/RXexpansionunitswith12drivebaysinor

R,RS411,,RS409+,RS409,
RS408-RP,RS408,RS407,DS3612xs,DS3611xs,
,,,DS710+,DS509+,
DS508, EDS14, RX1211, RX1211RP, RX4,
DX1211,DX510,DX5,VS240HDandRAMModule
(1GB/2GB/4GB/8GB).(3)"CategoryIIIProduct"
meansSynologyproductmodelsthatapplywiththe
followingrequirements:allDSNASmodelswithout
theXS+/XSsuffixandwith5andmoredrivebays
inorafter12-series,allRSNASmodelswithout
theXS+/XSsuffixinorafter12-series,andallDX/
RXexpansionunitswith4or5drivebaysinor

Product"meansallotherSynologyproductmodels
purchasedbyCustomerbeforeFebruary29,2008.
(b) "Refurbished Product" means all Synology
productswhichhavebeenrefurbishedandsold
directly by Synology through Online Store, not
includingthosesoldbyanauthorizedSynology
distributororreseller.(c)"Customer"meansthe
originalpersonorentitypurchasingtheProduct
fromSynologyoranauthorizedSynologydistributor
orreseller.(d)"OnlineStore"meansanonlineshop
operatedbySynologyorSynology’saffiliate.(e)
"Product"meansaNewProductoraRefurbished
Productandanyhardwareincorporatedintothe
Product by Synology and any accompanying
documentation.(f)"Software"meanstheSynology
proprietarysoftwarethataccompaniestheProduct
when purchased by Customer, is downloaded
byCustomerattheWebSite,orispre-installed
on the Product by Synology, and includes any
firmware,associatedmedia,images,animations,
video,audio,textandappletsincorporatedintothe
softwareorProductandanyupdatesorupgrades
tosuchsoftware.(g)"WarrantyPeriod"means
theperiodcommencingonthedatetheProductis
purchasedbyCustomerandending(1)fiveyears
aftersuchdateforCategoryIProducts;(2)three
yearsaftersuchdateforCategoryII&lllProducts;
or (3) two years after such date for Category
IVProducts;or(4)oneyearaftersuchdatefor
CategoryVProducts;or(5)90daysaftersuchdate
forRefurbishedProducts,exceptforthosesoldas
"asis"orwith"nowarranty"onOnlineStore.(h)
"WebSite"meanstheSynologywebsitelocatedat
www.synology.com.
Section 2. Limited Warranty and Remedies
2.1
Limited Warranty.
SubjecttoSection2.6,
SynologywarrantstoCustomerthateachProduct
(a)willbefreeofmaterialdefectsinworkmanship
and(b)undernormalusewillperformsubstantially
in accordance with Synology's published
specificationsfortheProductduringtheWarranty
Period.SynologywarrantstheSoftwareassetforth
intheaccompanyingenduserlicenseagreement
providedwiththeProduct,ifany.Synologyprovides
nowarrantytoRefurbishedProductsoldas“asis”
orwith“nowarranty”onOnlineStore.
2.2
Exclusive Remedy.
If Customer gives
noticeofnoncompliancewithanyofthewarranties
set forth in Section 2.1 within the applicable
WarrantyPeriodinthemannersetforthbelow,
then,uponverificationofthenoncomplianceby
Synology, Synology will, at Synology's option:
(a)usecommerciallyreasonableeffortstorepair
the Product, or (b) replace the noncomplying
Productorpartthereofuponreturnofthecomplete
Product in accordance with Section 2.3 The
foregoingsetsforthSynology'sentireliabilityand
Customer's sole and exclusive remedy for any
breachofwarrantyunderSection2.1oranyother
defect or deficiency in the Product. Customer
willreasonablyassistSynologytodiagnoseand
validateanynonconformitywiththeProduct.The
warrantysetforthinSection2.1doesnotinclude:
(1) any warranty relating to the Software; (2)
physical installation or removal of the Product
fromCustomer'ssite;(3)visitstoCustomer'ssite;
(4)labornecessarytoeffectrepairsorreplace
defectivepartsotherthanduringSynology'sor
its contracted service providers' normal local
businesshours,exclusiveofweekendsandservice
providers’holidays;(5)anyworkwithanythirdparty
equipmentorsoftware;(6)anywarrantyofthehard
diskifinstalledbyCustomeroranyotherthirdparty;
or(7)anywarrantyofcompatibilitywiththehard
disk.
2.3
Return.
AnyProductreturnedbyCustomer
under Section 2.2 must be assigned a Return
MerchandiseAuthorization ("RMA") number by
Synologybeforeshipmentandmustbereturned
inaccordancewithSynology'sthencurrentRMA
procedures.Customermaycontactanyauthorized
SynologydistributororresellerorSynologySupport
to obtain assistance in obtaining an RMA, and
mustprovideproofofpurchaseandproductserial
number when asking for such assistance. For
