THE LIMITED WARRANTIES PROVIDED ABOVE ARE THE SOLE AND EXCLUSIVE
WARRANTIES PROVIDED BY PROTEAM TO YOU, AND ARE IN LIEU OF ALL OTH-
ER WARRANTIES, WRITTEN OR ORAL, EXPRESS OR IMPLIED, WHETHER ARISING
BY OPERATION OF LAW OR OTHERWISE, INCLUDING, WITHOUT LIMITATION,
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE,
WHETHER OR NOT THE PURPOSE HAS BEEN DISCLOSED AND WHETHER OR
NOT THE PRODUCT HAS BEEN SPECIFICALLY DESIGNED OR MANUFACTURED
FOR YOUR USE OR PURPOSE. THE FOLLOWING SENTENCE APPLIES ONLY TO
CONSUMER PURCHASERS: DISCLAIMERS OF IMPLIED WARRANTIES, INCLUD-
ING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE, SHALL NOT TAKE EFFECT UNTIL THE
END OF THE WARRANTY PERIOD. No employee, agent, dealer, or other person
is authorized to alter this limited warranty or make any other warranty on behalf
of ProTeam. The terms of this limited warranty shall not be modified by ProTeam,
the original owner, or their respective successors or assigns.
Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PROTEAM BE LIABLE
FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES,
INCLUDING ANY ECONOMIC LOSS, WHETHER RESULTING FROM NONPER-
FORMANCE, USE, MISUSE OR INABILITY TO USE THE PRODUCT OR PROTEAM’S
NEGLIGENCE. SELLER SHALL NOT BE LIABLE FOR DAMAGES CAUSED BY DELAY
IN PERFORMANCE AND IN NO EVENT, REGARDLESS OF THE FORM OF THE
CLAIM OR CAUSE OF ACTION (WHETHER BASED IN CONTRACT, INFRINGE-
MENT, NEGLIGENCE, STRICT LIABILITY, OTHER TORT OR OTHERWISE), SHALL
PROTEAM'S LIABILITY TO YOU AND/OR YOUR CUSTOMERS EXCEED THE
PURCHASE PRICE PAID BY YOU FOR THE PRODUCT. The term "consequential
damages" shall include, but not be limited to, loss of anticipated profits, business
interruption, loss of use or revenue, cost of capital or loss or damage to property
or equipment.
Some states do not allow the exclusion or limitation of incidental or consequen-
tial damages, so the above limitation may not apply to you.
This limited warranty gives you specific legal rights, and you may also have other
rights which vary from State to State.
This limited warranty is governed by the laws of the State of Missouri, U.S.A.,
without regard to conflicts of law provisions.
Dispute Resolution
In the event of any dispute INCLUDING, BUT NOT LIMITED TO, BREACH OF
CONTRACT, BREACH OF WARRANTY, CLAIMS BASED IN TORT, NEGLIGENCE,
PRODUCT LIABILITY, FRAUD, MARKETING, STATE OR FEDERAL REGULATIONS,
ANY CLAIMS REGARDING THE ENFORCEABILITY OF THIS LIMITED WARRANTY,
AND THE WAIVER OF CLASS ACTION TRIALS between PROTEAM AND YOU, ei-
ther party may choose to resolve the dispute by binding arbitration, as described
below, instead of in court. THIS MEANS IF EITHER PROTEAM OR YOU CHOOSE
BINDING ARBITRATION, NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE
SUCH CLAIM IN COURT OR HAVE A JURY TRIAL. DISCOVERY AND APPEAL
RIGHTS ARE LIMITED IN BINDING ARBITRATION. ProTeam and You agree that
the proper venue if Arbitration is not so chosen by ProTeam OR You of all actions
arising in connection herewith shall be only in the state of Missouri and the par-
ties agree to such jurisdiction. No action, regardless of form, arising out of trans-
actions relating to the agreement, may be brought by either party more than
two (2) years after the cause of action has accrued. The U.N. Convention on
Contracts for the International Sales of Goods shall not apply to this agreement.
Class Action Waiver
BINDING ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. THIS MEANS NEI-
THER PROTEAM OR YOU MAY JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION
BY OR AGAINST OTHERS, OR LITIGATE IN COURT OR ARBITRATE ANY CLAIMS
AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY
GENERAL CAPACITY.
Administration of Arbitration
The binding arbitration must be administered by the American Arbitration
Association (“AAA”) in accordance with its Commercial Arbitration Rules and/
or Supplementary Procedures for Consumer-Related Disputes (including

POR EFECTO DE LA LEY COMO DE OTRA MANERA, INCLUYENDO, SIN LIMITACIÓN,
LAS GARANTÍAS DE COMERCIABILIDAD O IDONEIDAD PARA UN PROPÓSITO ESPECÍ-
FICO, TANTO SI EL PROPÓSITO HA SIDO REVELADO COMO SI NO LO HA SIDO Y SI EL
PRODUCTO HA SIDO O NO HA SIDO DISEÑADO O FABRICADO ESPECÍFICAMENTE
PARA EL USO QUE USTED LE VAYA A DAR O PARA EL PROPÓSITO QUE USTED TENGA.
LA SIGUIENTE FRASE SE APLICA SOLAMENTE A LOS COMPRADORES QUE SEAN CON-
SUMIDORES: LOS DESCARGOS DE RESPONSABILIDAD DE LAS GARANTÍAS IMPLÍCITAS,
INCLUYENDO SIN LIMITACIÓN LAS GARANTÍAS IMPLÍCITAS DE COMERCIABILIDAD
E IDONEIDAD PARA UN PROPÓSITO ESPECÍFICO, NO ENTRARÁN EN VIGOR HASTA
EL FINAL DEL PERÍODO DE GARANTÍA. Ningún empleado, agente, distribuidor u otra
persona está autorizado para alterar esta garantía limitada u ofrecer cualquier otra garantía
en nombre de ProTeam. Los términos de esta garantía limitada no serán modificados por
ProTeam, el propietario original o sus respectivos sucesores o cesionarios.
Limitación de responsabilidad
EN LA MEDIDA EN QUE ESTÉ PERMITIDO POR LA LEY, PROTEAM NO SERÁ RESPON-
SABLE EN NINGÚN CASO POR DAÑOS INCIDENTALES, ESPECIALES, INDIRECTOS
O EMERGENTES, INCLUSIVE CUALQUIER PÉRDIDA ECONÓMICA, TANTO SI SON EL
RESULTADO DE UN RENDIMIENTO DEFICIENTE COMO DE UTILIZACIÓN, USO INCOR-
RECTO O INCAPACIDAD PARA UTILIZAR EL PRODUCTO O NEGLIGENCIA POR PARTE
DE PROTEAM. EL VENDEDOR NO SERÁ RESPONSABLE POR LOS DAÑOS CAUSADOS
POR UNA DEMORA EN LA EJECUCIÓN Y, CON INDEPENDENCIA DE LA FORMA DE
RECLAMO O LA CAUSA DE ACCIÓN (TANTO SI SE BASA EN CONTRATO COMO EN
INCUMPLIMIENTO, NEGLIGENCIA, RESPONSABILIDAD ESTRICTA, OTRO AGRAVIO O
CUALQUIER OTRA COSA), LA RESPONSABILIDAD DE PROTEAM HACIA USTED Y/O LOS
CLIENTES DE USTED NO EXCEDERÁ EN NINGÚN CASO EL PRECIO QUE USTED HAYA
PAGADO POR EL PRODUCTO. La expresión "daños emergentes" incluirá, pero no estará
limitada a, pérdida de ganancias previstas, interrupción del negocio, pérdida de uso o
ingresos, costo de capital o pérdida de bienes o equipos o daños a los mismos.
Algunos estados no permiten la exclusión o limitación de los daños incidentales o
emergentes, por lo que es posible que la limitación que antecede no tenga aplicación en
el caso de usted.
Esta garantía limitada le confiere a usted derechos legales específicos y es posible que
usted tenga también otros derechos que varían de un estado a otro.
Esta garantía limitada se rige por las leyes del estado de Missouri, EE.UU., con indepen-
dencia de las disposiciones sobre conflictos de leyes.
Resolución de Disputas

AGRAVIO, NEGLIGENCIA, RESPONSABILIDAD POR PRODUCTOS DEFECTUOSOS,
FRAUDE, MARKETING, REGLAMENTOS ESTATALES O FEDERALES, CUALQUIER REC-
LAMO RELACIONADO CON LA EJECUTABILIDAD DE ESTA GARANTÍA LIMITADA Y LA
RENUNCIA A JUICIOS POR DEMANDA COLECTIVA entre PROTEAM Y USTED, cualquiera
de las dos partes podrá optar por resolver la disputa mediante arbitraje vinculante, tal y
como se describe a continuación, en lugar de ante un tribunal. ESTO SIGNIFICA QUE SI
PROTEAM O USTED OPTAN POR EL ARBITRAJE VINCULANTE, NINGUNA DE LAS DOS
PARTES TENDRÁ DERECHO A LITIGAR DICHO RECLAMO ANTE UN TRIBUNAL NI A
TENER UN JUICIO CON JURADO. LOS DERECHOS AL PROCESO DE DESCUBRIMIENTO,
ASÍ COMO LOS DERECHOS DE APELACIÓN, ESTÁN LIMITADOS EN EL ARBITRAJE
VINCULANTE. ProTeam y Usted aceptan que si ProTeam O Usted no escogen el Arbitraje
como vía de resolución, la jurisdicción adecuada para todas las acciones que surjan en rel-
ación con el presente estará solamente en el estado de Missouri y las partes aceptan dicha

vous fournira le RAM et les instructions d’expédition de votre produit vers les ateliers
de réparation de ProTeam.

LES GARANTIES LIMITÉES DÉCRITES CI-DESSUS SONT LES SEULES GARANTIES OF-
FERTES PAR PROTEAM ET TIENNENT EN LIEU ET PLACE DE TOUTE AUTRE GARAN-
TIE, ÉCRITE OU VERBALE, EXPRESSE OU IMPLICITE, DÉCOULANT DE L'APPLICATION
DE LA LOI OU AUTREMENT ET INCLUANT, MAIS SANS Y ÊTRE LIMITÉ, TOUTE
GARANTIE DE QUALITÉ MARCHANDE, D’ADAPTATION À UN USAGE PARTICULIER,
DIVULGUÉ OU NON, ET QUE LE PRODUIT AIT ÉTÉ OU NON SPÉCIFIQUEMENT
CONÇU OU FABRIQUÉ POUR L’USAGE QUE VOUS EN FAITES. LA PHRASE SUIVANTE
S’ADRESSE AUX CONSOMMATEURS ACHETEURS SEULEMENT : LES EXCLUSIONS
DE GARANTIE IMPLICITE Y COMPRIS, SANS Y ÊTRE LIMITÉ, TOUTE GARANTIE DE
QUALITÉ MARCHANDE, D’ADAPTATION À UN USAGE PARTICULIER, NE DOIVENT
PRENDRE EFFET QU’À L’ISSU DE LA PÉRIODE DE GARANTIE. Aucune autre personne,
employé, agent, détaillant n'est autorisé à modifier, de quelque façon que ce soit, la
présente garantie limitée ou à lier ProTeam à aucune autre garantie que ce soit. Les
dispositions de la présente garantie limitée ne peuvent être modifiées par ProTeam,
le propriétaire original, leurs successeurs ou leurs ayants droit respectifs de quelque
manière que ce soit.
Limitation de responsabilité
DANS TOUTE LA MESURE PRÉVUE PAR LA LOI, EN AUCUNE CIRCONSTANCE PRO-
TEAM NE SERONT TENUE RESPONSABLE DES DOMMAGES-INTÉRÊTS MINEURS,
SPÉCIAUX, INDIRECTS OU CONSÉCUTIFS, INCLUANT TOUTE PERTE MONÉTAIRE
RÉSULTANT DE LA PERTE D’UTILISATION, DE L’UTILISATION, DE L’USAGE ABUSIF
OU DE L’INCAPACITÉ D’UTILISER LE PRODUITS OU DU DÉFAUT DE PROTEAM. LE
VENDEUR NE POURRA ÊTRE TENU RESPONSABLE DES DOMMAGES-INTÉRÊTS
RÉSULTANT D’UN RETARD D’EXÉCUTION ET, EN AUCUN CAS, SANS ÉGARD À LA
FORME QUE PREND LA RÉCLAMATION OU LA CAUSE D’ACTION (QU’ELLE SOIT
FONDÉE SUR UN CONTRAT, UNE VIOLATION, LA NÉGLIGENCE, LA RESPON-
SABILITÉ STRICTE, UNE AUTRE ACTION DÉLICTUELLE DE QUELQUE NATURE QUE
CE SOIT), LA RESPONSABILITÉ DE PROTEAM NE SAURA, EN AUCUN CAS, EXCÉDER
LE PRIX D’ACHAT DU PRODUIT. L’expression « dommages-intérêts consécutifs »
comprend, sans y être limité, la perte de profits anticipés, l’interruption des activités
commerciales, la perte d’usage ou de revenus, coût de dépenses en immobilisations
ou les pertes ou dommages à la propriété ou à l’équipement.
Certaines juridictions n’autorisant pas l’exclusion ou la limitation aux dommages-
intérêts accessoires ou consécutifs, il est possible que la limitation ci-dessus ne soit pas
applicable selon le cas.
Bien que cette garantie limitée vous accorde des garanties juridiques spécifiques, vous
pourriez avoir d'autres droits qui varient selon les juridictions.
La présente garantie est régie par les lois applicables l’état du Missouri, É.-U., sans
égard aux principes gouvernant les conflits de lois.
Résolution de Différends
En cas de différends notamment, sans y être limité, TOUT MANQUEMENT AU
CONTRAT ET MANQUEMENT AUX OBLIGATIONS EN MATIÈRE DE GARANTIE,
TOUTE RÉCLAMATION FONDÉE SUR LA RESPONSABILITÉ DÉLICTUELLE, LA NÉGLI-
GENCE, LA RESPONSABILITÉ DU FAIT DU PRODUIT, LA FRAUDE, LE MARKETING,
LES RÈGLEMENTS DE L’ÉTAT OU DU FÉDÉRAL, TOUTE RÉCLAMATION RELATIVE
À L’EXÉCUTION DE LA PRÉSENTE GARANTIE LIMITÉE ET LA RENONCIATION À
D’ÉVENTUELS RECOURS COLLECTIFS entre PROTEAM ET VOUS-MÊME, l’une des
parties peut choisir de régler le différend par arbitrage exécutoire, tel que décrit
ci-dessous, plutôt que devant les tribunaux, PAR CONSÉQUENT, SI LES DEUX PARTIES
CHOISISSENT L’ARBITRAGE EXÉCUTOIRE, AUCUNE D’ELLES N’AURA LE DROIT
D’ENTAMER DES POURSUITES DEVANT LES TRIBUNAUX NI LE DROIT À UN PROCÈS
DEVANT JURY. LE DROIT D’INTERROGATOIRE PRÉALABLE ET LE DROIT D’APPEL
