13 - WARRANTY

WARRANTY CERTIFICATE

GENERAL TERMS OF WARRANTY

 

Duration and subject of warranty

1.

 MAM  guarantees its products against manufacturing flaws and defects, with the express exception of any flaw or fact related 

to assembly and 

maintenance of the product and its optimal operation (art. 1512 c.p.c.).

2.

 The duration of the warranty is:

- 24 months/    years for electrical, mechanical equipment and burners.

Terms and exclusions:

 The warranty is valid as of the date of initial testing, as stated on the report drawn up by the Assistance Centre, and in any event 

no more than one year from the date of supply to the Purchaser Client. The warranty only applies if the supply has been promptly 

paid for by the Purchaser Client.

4.

 The full compilation of the initial test report, form A by the authorised Assistance Centre or directly by the undersigned, 

establishes validity of the warranty itself. This certificate must be returned to MAM within 8 days of the initial operation test. If the 

initial test report is lost or compiled incorrectly, the serial number, stated on the ID data plate can be used to establish validity of 

the report.

5.

 The Purchaser Client shall no longer be entitled to the warranty if the defect is not reported within 8 days of detection, and 

before the expiry date of the warranty validity.

Exclusions and conditions of warranty validity:

 No warranty will be acknowledged for damage caused by inappropriate or improper use, assembly, or incorrect start-up 

by the purchaser client or third parties, or normal wear, inappropriate or negligent treatment, devices not suited to operation 

or following continuous used after detecting malfunctions, the incorrect selection of a burner or incorrect calibration of the 

latter, the use of unsuitable fuels or chemical, electrochemical or electrical currents, unless attributable to the retailer, failure 

to observe instructions for the assembly, operation and improper maintenance or modifications/maintenance work by the 

purchaser or third parties, or effects caused by external connected devices.

7.

 The seller expressly informs the client that no warranty will be acknowledged for parts subject to normal wear and tear, such 

as burner nozzles, burner devices used to reduce emissions, batteries or seals, combustion chamber coatings or parts of the 

ignition and control devices in contact with the flame.

8.

 The manufacturer’s warranty obligations are also not valid for damage caused by impurities in the air due to a high content 

of dust or acid vapours or following installation in inappropriate environments.

9.

 No warranty will be acknowledged if the purchaser client appoints unqualified companies to perform installation of MAM 

products, in accordance with the law.

10.

 The devices must be installed professionally in observance of current legislation in terms of certification, operation and 

envisaged exceptions, 

and must undergo periodic inspections as envisaged by law. Failure to observe the latter will render the warranty null and void.

11.

 MAM  declines all liability for the failure to notify the competent local authorities of the possession and installation of 

pressure recipients.

12.

 The warranty is valid for all products sold in Italy by MAM. The obligations of MAM do not extend to products purchased 

through non-conventional sales channels such as the Internet.

13.

 The warranty is valid in the territories of Italy, the Vatican State, and the Republic of San Marino.

Services under warranty:

14.

 Interventions under warranty are at the sole discretion of MAM and concern the repairs, and replacement of defective parts. 

For this purpose, the purchaser 

undertakes to arrange repairs deemed essential by MAM to enable access to the system, at the end client’s premises.

15.

 Parts and/or components replaced under warranty remain the property of MAM, which must be returned to the latter ex 

works.

Any procedures requested by the purchaser client for inspections, modifications or other operation not related to the warranty 

shall be charged accordingly.

16.

 The warranty does not apply, under any circumstances, to the reimbursement for assembly, disassembly or transport costs.

17.

 The sale is exempt from the obligation of warranty in the event of delayed payments or failure to pay by the purchaser client.

18.

 Claims for damages due to defects of products are excluded from the warranty, with express reference to the specifications of art. 

1494 of the Italian civil code, or for delays in interventions for repairs.
