9 Warranty
For a period of 12 months from the date of delivery to the purchaser, Ergoline guarantees that, at
the time of delivery, the equipment is free of defects that could negate or impair its value or
suitability for normal use.
The warranty period covering defects is 12 months from the date of delivery or a maximum of
1,500 operating hours within the one-year warranty period.
The warranty and liability shall be rendered invalid if:
•
=
the equipment is modified or altered in a way that is not in keeping with the purpose for
which it was intended,
•
=
proof cannot be provided of date and place of purchase of the equipment.
Ergoline guarantees to correct faults, or have faults corrected, free of charge where it can be
shown that they have occurred within twelve months of the equipment being delivered. This
correction may take the form of replacement of defective components or of the complete product,
at Ergoline's discretion.
The purchaser is however entitled to cancel the contract or to demand a reduction of the
purchase price if the corrective action taken is ineffective, particularly because it
•
=
proves to be not possible,
•
=
Ergoline fails to correct the fault or faults within a reasonable period of time,
•
=
Ergoline refuses to take, or culpably delays, corrective action.
Claims beyond this, in particular claims to compensation for damage that does not arise on the
equipment itself or results from corrective action or from the delivery of replacement parts being
made too late, are excluded.
The foregoing exclusion does not apply if Ergoline is guilty of intent or gross negligence or the
product is missing warranted properties.
Claims under warranty must be accompanied by the invoice being submitted to Ergoline or
asserting them to the Ergoline dealer who delivered the equipment.
