Chapter 1 - Warranty
given certain environmental conditions and are not covered by the terms and conditions of this
Limited Warranty.
Damon will not pay for the cost of repairing or replacing items that are damaged as a result of lack of care,
prevention or improper use, nor for damage to other parts of the RV that result from such lack of care,
prevention or improper use. By design, these products are not intended or equipped to meet the needs of
a permanent or semi-permanent home; therefore, any such use shall void Damon’s Limited Warranty.
LIMITATION AND DISCLAIMER OF IMPLIED WARRANTIES
ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR OTHER IM-
PLIED WARRANTIES APPLICABLE TO THIS RV ARE LIMITED TO THE DURATION OF DAMON’S EXPRESS
WRITTEN LIMITED WARRANTY OF TWELVE (12) MONTHS OR TWELVE THOUSAND (12,000) MILES,
WHICHEVER COMES FIRST; OR IN THE CASE OF THE STEEL OR ALUMINUM FRAME STRUCTURE OF THE
ROOF, FRONT AND REAR WALLS AND SIDEWALLS (EXCLUDING SLIDE-OUTS), FOR TWENTY FOUR (24)
MONTHS OR 24,000 MILES, WHICHEVER OCCURS FIRST. PERFORMANCE OF REPAIRS OR NEEDED ADJUST-
MENTS IS THE EXCLUSIVE REMEDY UNDER THIS WRITTEN LIMITED WARRANTY OR ANY IMPLIED WARRAN-
TY. DAMON SHALL NOT BE
LIABLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOST WAG-
ES, LOST TIME, COMMERCIAL LOSS, LEGAL EXPENSE, PAYMENTS ON ANY INSTALLMENT LOAN, TOWING,
VEHICLE RENTAL OR TEMPORARY LIVING EXPENSES) RESULTING FROM BREACH OF THIS WRITTEN LIM-
ITED WARRANTY OR ANY IMPLIED WARRANTY.
SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY WILL LAST OR THE
EXCLUSION OR LIMITATIONS OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITA-
TIONS MAY NOT APPLY TO YOU.
Damon makes no warranty or other representation with respect to the condition of the RV beyond that
contained in this warranty. Any opinions or representations contained in any promotional literature with
respect to the RV or any other Damon product are strictly the opinion of Damon, and do not constitute
a warranty of any kind, including any warranty of performance or quality. No person, including without
limitation any independent, authorized dealer, has the authority to enlarge, amend, or modify this Lim-
ited Warranty.
JURISDICTION AND APPLICABLE LAW
Exclusive jurisdiction for deciding any claims, demands or causes of action for defects or representations
of any nature or damages due from such defects or representations shall be in the courts in the state
of manufacture. The laws applicable to any litigation, dispute, mediation, arbitration or any claim what-
soever arising from the sale, purchase or use of the RV shall be those of the state of manufacture. Any ac-
tion to enforce the terms of Damon’s Limited Warranty shall be commenced not more than three (3)
months after expiration of the applicable warranty period. Any performance of repairs shall not suspend
this three month limitation from expiring. Any performance of repairs after the warranty coverage period
has expired, or performance of repairs regarding anything excluded from coverage under this Limited
Warranty shall be considered “good will” repairs, and they will not alter the express terms of this limited
warranty, or extend the warranty coverage period or this limitation period.
CALIFORNIA ARBITRATION CERTIFICATION PROGRAM
Damon Corporation participates in the Consumer Arbitration Program for Recreation Vehicles (CAP-RV).
This third-party dispute resolution program is available, at no charge to you, to settle unresolved warran-
ty disputes for recreation vehicles. This dispute resolution program reviews eligible product and service
related complaints involving warranty covered components.
