8.0
Save where the Goods are sold to a person dealing as a consumer
(within the meaning of the Unfair Contract Terms Act 1977) all
warranties conditions or other terms implied by law or custom are
excluded to the fullest extent permitted by law.
9.0
Engines Plus Ltd shall under no circumstances be liable for any
indirect or consequential loss, loss of profits, loss of savings, loss of
business or loss of contract. Engines Plus Ltd’s liability whether in
contract, tort (including negligence), breach of statutory duty or
otherwise shall not exceed the price of the Goods in respect of which
any claim arises PROVIDED THAT nothing in these Conditions shall
restrict or exclude Engines Plus Ltd’s liability for death or personal
injury caused by its negligence.
