What Art of Heat Will Do
If the products are returned and tested and Art of Heat does not consider the products to be
faulty, you will be notified and may elect to have the product disposed of, repaired/replaced
at your expense, or the product will be returned to you at your expense. Products received
under this warranty with (i) visible damage due to misuse (or with any other Not Covered
Damage), (ii) with a Voidable Action under this warranty hereto, or (iii) improper packaging are
not eligible for warranty service and will be returned to the owner at the owner’s option.If after
testing, the products are deemed defective, Art of Heat will, at its sole option either repair or
replace the defective products. In the event the product is obsolete, Art of Heat will notify the
customer and replace the defective product with an alternative equivalent or superior product.
Art of Heat will not be responsible for any associated costs if the mounting configuration of the
new product is different from the original product being repaired or replaced.
What Art of Heat Will Not Do Under This Limited Warranty
You assume all risks of loss or damage during return shipment to Art of Heat.
Art of Heat will not be responsible for any costs related to the removal or any installation of this
product.
How to Obtain a Remedy Under This Limited Warranty
To obtain a remedy under this limited warranty, you must have purchased directly from Art of
Heat, provide evidence of purchase with a copy of the original digital receipt, and complete
our warranty claim process as found from Contact Us on our website. During the remaining
Warranty Term from the date of purchase return the products to us (at your own expense and
risk) Customer’s not holding an extended warranty must make a payment of $150.00 USD
handling charge, customers with an extended warranty do not need to pay a $150.00 handling
charge.
Limitation of Liability and Remedy
THE WARRANTY PROVIDED HEREIN SHALL BE THE SOLE AND EXCLUSIVE WARRANTY.
THERE SHALL BE NO OTHER WARRANTIES EXPRESS OR IMPLIED INCLUDING ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY
OTHER OBLIGATION ON THE PART OF ART OF HEAT WITH RESPECT OF PRODUCTS
COVERED BY THIS WARRANTY. ART OF HEAT SHALL HAVE NO LIABILITY FOR ANY
INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES ARISING WITH RESPECT TO THE
PRODUCT, WHETHER BASED UPON NEGLIGENCE, TORT, STRICT LIABILITY, OR CONTRACT.
NOTHING IN THIS SECTION SHALL LIMIT OR EXCLUDE THE ABOVE MENTIONED LIABILITY
WHETHER OR NOT ART OF HEAT OR ITS AGENTS OR AFFILIATES ARE IN PART NEGLIGENT IN
RELATION TO PRODUCT LIABILITY ISSUES. IN NO EVENT SHALL THIS WARRANTY REQUIRE
MORE THAN THE REPAIR OR REPLACEMENT OF ANY PART OR PARTS WHICH ARE FOUND
TO BE DEFECTIVE WITHIN THE EFFECTIVE PERIOD OF THE WARRANTY. NO REFUNDS WILL
BE GIVEN. IF REPLACEMENT PARTS FOR DEFECTIVE MATERIALS ARE NOT AVAILABLE, ART
OF HEAT RESERVES THE RIGHT TO MAKE PRODUCT SUBSTITUTIONS IN LIEU OF REPAIR OR
REPLACEMENT.
