PUCHASEDBYYOU(THE“PRODUCT”),ORLEGALLYDOWNLOADEDFROMWWW.SYNOLOGY.COM,
ORANYOTHERCHANNELPROVIDEDBYSYNOLOGY("SOFTWARE").
YOUAGREETOBEBOUNDBYTHETERMSOFTHISEULABYUSINGTHEPRODUCTSCONTAINING
THESOFTWARE,INSTALLINGTHESOFTWAREONTOTHEPRODUCTSORDEVICECONNECTED
TOTHEPRODUCTS.IFYOUDONOTAGREETOTHETERMSOFTHISEULA,DONOTUSETHE
PRODUCTS CONTAINING THE SOFTWAREOR DOWNLOAD THE SOFTWARE FROM WWW.
SYNOLOGY.COM, ORANY OTHER CHANNEL PROVIDED BY SYNOLOGY. INSTEAD,YOU MAY
RETURNTHEPRODUCTTOTHERESELLERWHEREYOUPURCHASEDITFORAREFUNDIN
ACCORDANCEWITHTHERESELLER'SAPPLICABLERETURNPOLICY.
Section 1. Limited Software License.
Subject
to the terms and conditions of this EULA,
Synologygrantsyoualimited,non-exclusive,non-
transferable,personallicensetoinstall,runanduse
onecopyoftheSoftwareloadedontheProduct
oronyourdeviceconnectedtotheProductsolely
relatingtoyourauthorizeduseoftheProduct.
Section 2. Documentation.
You may make
anduseareasonablenumberofcopiesofany
documentationprovidedwiththeSoftware;provided
that such copies will only be used for internal
businesspurposesandarenottoberepublishedor
redistributed(eitherinhardcopyorelectronicform)
toanythirdparty.
Section 3. Backup.
Youmaymakeareasonable
numberofcopiesoftheSoftwareforbackupand
archivalpurposesonly.
Section 4. Updates.
Anysoftwareprovidedtoyou
bySynologyormadeavailableontheSynology
websiteatwww.synology.com("Website")orany
otherchannelprovidedbySynologythatupdates
orsupplementstheoriginalSoftwareisgoverned
bythisEULAunlessseparatelicensetermsare
provided with such updates or supplements, in
whichcase,suchseparatetermswillgovern.
Section 5. License Limitations.
Thelicenseset
forthinSections1,2and3appliesonlytotheextent
thatyouhaveorderedandpaidfortheProductand
statestheentiretyofyourrightswithrespecttothe
Software.Synologyreservesallrightsnotexpressly
grantedtoyouinthisEULA.Withoutlimitingthe
foregoing,youshallnotauthorizeorpermitany
thirdpartyto:(a)usetheSoftwareforanypurpose
otherthanthatinconnectionwiththeProduct;(b)
license,distribute,lease,rent,lend,transfer,assign
orotherwisedisposeoftheSoftware;(c)reverse
engineer,decompile,disassembleorattemptto
discoverthesourcecodeoforanytradesecrets
relatedtotheSoftware,exceptandonlytothe
extentthatsuchconductisexpresslypermitted
byapplicablelawnotwithstandingthislimitation;
(d)adapt,modify,alter,translateorcreateany
derivativeworksoftheSoftware;(e)remove,alter
orobscureanycopyrightnoticeorotherproprietary
rights notice on the Software or Product; or (f)
circumventorattempttocircumventanymethods
employedbySynologytocontrolaccesstothe
components,featuresorfunctionsoftheProduct
orSoftware.Subjecttothelimitationsspecifiedin
thisSection5,youarenotprohibitedfromproviding
anyserviceshostedbySynologyNASservertoany
thirdpartyforcommercialpurpose.
Section 6. Open Source.
The Software may
containcomponentslicensedtoSynologyunderthe
GNUGeneralPublicLicense("GPLComponents"),
currentlyavailableathttp://www.gnu.org/licenses/
gpl.html.ThetermsoftheGPLwillcontrolsolely
withrespecttotheGPLComponentstotheextent
that this EULA conflicts with the requirements
oftheGPLwithrespecttoyouruseoftheGPL
Components,and,insuchevent,youagreetobe
boundbytheGPLwithrespecttoyouruseofsuch
components.
Section 7. Audit.
Synologywillhavetherightto
audityourcompliancewiththetermsofthisEULA.
You agree to grant Synology a right to access
toyourfacilities,equipment,books,recordsand
documentsandtootherwisereasonablycooperate
withSynologyinordertofacilitateanysuchauditby
SynologyoritsagentauthorizedbySynology.
Section 8. Ownership.
TheSoftwareisavaluable
propertyofSynologyanditslicensors,protectedby
copyrightandotherintellectualpropertylawsand
treaties.Synologyoritslicensorsownallrights,
titlesandinterestsinandtotheSoftware,including
butnotlimitedtocopyrightandanyotherintellectual
propertyrights.
Section 9. Limited Warranty.
Synologyprovides
alimitedwarrantthattheSoftwarewillsubstantially
conformtoSynology'spublishedspecificationsfor
theSoftware,ifany,orotherwisesetforthonthe
Website,foraperiodrequiredbyyourlocallaw.
Synologywillusecommerciallyreasonableefforts
to,inSynology'ssolediscretion,eithercorrectany
suchnonconformityintheSoftwareorreplaceany
Softwarethatfailstocomplywiththeforegoing
warranty,providedthatyougiveSynologywritten
noticeofsuchnoncompliancewithinthewarranty
period.Theforegoingwarrantydoesnotapplyto
anynoncomplianceresultingfromany:(w)use,
reproduction, distribution or disclosure not in
accordancewiththisEULA;(x)anycustomization,
modificationorotheralterationoftheSoftwareby
anyoneotherthanSynology;(y)combinationofthe
Softwarewithanyproduct,servicesorotheritems
providedbyanyoneotherthanSynology;or(z)your
failuretocomplywiththisEULA.
