implied, including, but not limited to, any implied warranties of merchantability or fitness for a
particular purpose shall apply after the express warranty periods stated above. No other express
warranty or guaranty given by any person, firm or corporation with respect to this product shall be
binding on Sector 5. Sector 5 undertakes no responsibility for the quality of the product, and
assumes no responsibility that the product will be fit for any particular purpose for which you may
be buying the product, except as otherwise provided in this limited warranty or in applicable law.
No Sector 5 reseller, agent or employee is authorized to make any modification, extension or
addition to this warranty.
Except as provided in this warranty and to the maximum extent permitted by law, Sector 5 is not
responsible for direct, special, incidental or consequential damages resulting from any breach of
warranty or condition, or under any other legal theory, including but not limited to loss of use; loss
of revenue; loss of actual or anticipated profits (including loss of profits on contracts); loss of the
use of money; loss of anticipated savings; loss of business; loss of opportunity; loss of goodwill;
loss of reputation; loss of, damage to, compromise or corruption of data
;
or any indirect or
consequential loss or damage howsoever caused including the replacement of equipment and
property, any costs of recovering, programming, or reproducing any program or data stored in or
used with the Sector 5 product or any failure to maintain the confidentiality of information stored
on the Sector 5 product. Sector 5 disclaims any representation that it will be able to repair any
device under this warranty or replace the Sector 5 product without risk to or loss of information
stored in the Sector 5 product.
The foregoing limitation shall not apply to death or personal injury claims, or any statutory
liability for intentional and gross negligent acts and/or omissions. This limited warranty shall
not extend to anyone other than the original purchaser of this product, is nontransferable and
states your exclusive remedy.
If there is any contradiction between the limited warranty and any agreement and statement related to
Sector 5 products, this limited warranty shall govern. Sector 5 or its successor in title is the warrantor under
this warranty. If Sector 5 cannot lawfully disclaim implied warranties under this limited warranty, all such
warranties, including warranties of merchantability and fitness for a particular purpose are limited in
duration to the duration of this warranty.
CONSUMER PROTECTION AND OTHER LAWS MAY APPLY
Some states (countries and provinces) do not allow the exclusion or limitation of incidental or
consequential damages, so the above limitation or exclusion may not apply to you.
Some states
may provide for additional warranty rights and remedies, and the provisions contained in this limited
warranty are not intended to limit, modify, take away from, disclaim or exclude any mandatory warranty
requirements provided by states, including certain implied warranties. This warranty gives you specific legal
rights, and you may also have other rights which vary from state to state.
