the furnishing, performance or use of this material. The user guide
included with your original product purchase from ProSoft contains
information protected by copyright. No part of the guide may be duplicated
or reproduced in any form without prior written consent from ProSoft.
7.2.3 Disclaimer Regarding High Risk Activities
Product manufactured or supplied by ProSoft is not fault tolerant and is not
designed, manufactured or intended for use in hazardous environments requiring
fail-safe performance including and without limitation: the operation of nuclear
facilities, aircraft navigation of communication systems, air traffic control, direct
life support machines or weapons systems in which the failure of the product
could lead directly or indirectly to death, personal injury or severe physical or
environmental damage (collectively, "high risk activities"). ProSoft specifically
disclaims any express or implied warranty of fitness for high risk activities.
Warranty satisfaction is available only if (a) ProSoft is provided prompt notice of
the warranty claim and (b) ProSoft's examination discloses that any alleged
defect has not been caused by misuse; neglect; improper installation, operation,
maintenance, repair, alteration or modification by another party other than
ProSoft; accident; or unusual deterioration or degradation of the Products or
parts thereof due to physical environment or electrical or electromagnetic noise
environment.
