WARRANTY TERMS

For all products sold by Phoenix Technologies (hereinafter, “Phoenix”), a two-year limited warranty is offered to the purchaser from the 

date of delivery/purchasing in accordance to the Law on Warranty Consumer Goods of 23/2003.
The hereby warranty is bestowed without prejudice and in accordance to the legal rights granted to the end user upon the vendor by the 

Royal Decree 1/2007 of November 16th by which is approved the text gathered in the General Law for the Defense of Consumers and 

Users (Ley General para la Defensa de Consumidores y Usuarios – LCU) and other supplementary legislation. Therefore, all legal rights 

granted to the end user in accordance with the autonomic, national or European laws are not excluded or limited by.

How to claim on the warranty

If you want to make a claim under the terms of this warranty, you must provide a proof with fiscal value such as the original or simplified 

receipt of the purchase, which must clearly indicate the name and address of the vendor, the date and location of the purchase, the 

type of product and its serial number Under no circumstances will falsified or manipulated documents be accepted when claiming your 

warranty rights.  
All reparations covered by the warranty terms will have to be undertaken by the Technical Assistance Service of Phoenix Technologies.

 What isn’t cover? 

The warranty period for the batteries will be of six (6) months and 12 months for all transformers/chargers and accessories, since the latest are 

considered perishable products, in accordance with the Law on Warranty Consumer Goods of 23/2003 and so forth existing laws which will prevail 

over any point of this warranty that may contradict or diminish rights granted to the end user by the above mentioned laws.  
The warranty terms do not foresee, nor includes the regular revisions, maintenance revisions or the installation of the Product. 
Additionally, there will not be offence of conformity of the Product with the contact and, thereby, this will not be covered by the warranty policy in 

the following cases: 
• faults may be caused by discrepancies with the security or technical rules dictated by the local or national authorities of a different country from 

which the Product was ordinarily designed and produced; 
• when the Product or any of its identifying parts (e.g. serial number) have been partial or totally opened, assembled, disassembled, altered and/or 

repaired by a third party which does not belong to the Official Technical Assistance, nor to the authorized resellers of Phoenix;
• faults or damage resulting from incorrect use or installation of the Product, including, but not limited to, an use that contravenes the recommended 

use of the Product  or the instructions  provided  by Phoenix (e.g. failure to follow the instructions in the Product User Guide);
• faults may be caused by viruses introduced via unauthorized access (i.e. unauthorized by you or by a third party) to services, other accounts, 

networks or computer systems. Unauthorized access may be gained through hacking, the unlawful acquisition of passwords or similar means;
• faults resulting from the use of non-original accessories, chargers or consumer goods, and that are not supplied by Phoenix, nor have they been 

designed for the Product;
• presumed faults caused by using any software or application provided by third parties that modify, alter or adapt the software and/or service that 

has been approved and/or supplied by Phoenix;
• faults may be caused by downloads or the use of applications or multimedia data introduced via unauthorized access (i.e. unauthorized by you 

or by a third party) which are available and accessible through the Product. 
• faults resulting from short-circuiting of the battery; 
• faults resulting from the breakage of any of the casing’s seals or the battery seals or cells, or any evidence of manipulation of the very same; 

and/or
• other circumstances beyond the reasonable control of Phoenix such as damage or distortion of the Product due to thunderstorms, water, fire, use 

of incorrect voltage, wrong ventilation or any other cause which cannot be attributed to the manufacture and design of the Product. 
Phoenix shall not under any circumstances be held liable for any loss of data or content during the repair or replacement of the Product. Be sure 

to make security copies or backups to protect all important data against losses, damage or destruction of your data.   
None of the hereby warranty conditions cover the replacement of pieces   worn  down  or  with  broken  mechanisms,  tires,  casings and/or plastics, 

as well as any physical damage resulting from the normal use of the Product. Similarly, the warranty policy shall not cover any damage occurred 

during the handling or transportation of the Product (including, but not limited to, any outer damage such as blows, scratches, stains, dents, etc.). 

In all the above-mentioned cases, the regulations in force under the general purchasing conditions by Phoenix shall be applied.
