In accordance with the following terms and conditions, Techtronic Industries Australia Pty Ltd ABN 98 002 277 509 and Techtronic Industries New Zealand
Limited agrees to repair or replace at its own discretion any Milwaukee product (and any accessory supplied with it) that has been purchased in Australia or
New Zealand from an authorised Milwaukee stockist when the Product is determined by Techtronic Industries Australia Pty Ltd or Techtronic Industries New
Zealand Limited to have a defect in its material or workmanship.
The period of the warranty will vary depending on the Product. Please refer to the schedule below to determine the warranty period for your Product. The
warranty period commences from the date of sale of the Product by a retailer to the purchaser.
1. This Warranty:
a) Covers the Product only described against labour and faulty materials.
b) Covers the replacement of parts and the repair labour used, for the remainder of the warranty period.
2. This Warranty will not apply if:
a) The Product is opened by a person other than Techtronic Industries Australia Pty Ltd, Techtronic Industries New Zealand Limited or by an authorised
service centre.
b) Repairs made or attempted by other than Techtronic Industries Australia Pty Ltd, Techtronic Industries New Zealand Limited or the authorised
service centre’s.
c) Normal wear and tear. Parts such as carbon brushes, bearings, seals, o rings etc. must be regularly inspected so that the wear and tear on such
parts do not lead to failure of the tool. For optimum performance the tool should be inspected regularly by an authorised service centre.
d) Abuse, misuse, the subject of an accident , being dropped, crushed, impacted with any hard surface, exposed to extreme heat (including fire) or
cold, improper maintenance, continued use after partial failure.
e) Acts of God, vermin or foreign matter entering e.g. dirt and moisture.
f) The Product has been modified, incorrectly adjusted or operated, the subject of incorrect electrical supply or inconsistent electrical supply, used with
inappropriate accessories.
g) The Product is tampered with any way or if the damaged has been caused by any event of force majeure.
h) If the Product has not been used or maintained in accordance with the manufacturer’s instructions as provided with the product.
i) If the Product’s serial number, as applied by the manufacture, has been altered or removed from the product.
j) To the repair or replacement of any consumables relating to the Product.
k) Subject to clause 3, to the full extent permitted by law, Techtronic Industries Australia Pty Ltd and Techtronic Industries New Zealand Limited
aggregate liability for all claims made under this warranty will not exceed the original purchase price of the Product or, at Techtronic Industries
Australia Pty Ltd and Techtronic Industries New Zealand Limited election, the cost of replacing the Product. In no circumstances will Techtronic
Industries Australia Pty Ltd and Techtronic Industries New Zealand Limited be liable for any indirect or consequential loss arising from any defect in
the Product or for any loss of profits, loss of contracts, production downtime, damaged to goodwill or for any inconvenience caused.
l) Techtronic Industries Australia Pty Ltd and Techtronic Industries New Zealand Limited exclude all other warranties, conditions or obligations, either
expressed or implied.
3. Exclusion of implied warranties:
To the full extent permitted by law, all warranties, conditions and other terms implied by statute, custom or common
law are excluded. Nothing contained in these terms and conditions excludes or restricts any warranty, condition, right or remedy implied by any statute
(including the Trade Practices Act 1974 (cth)) which cannot be excluded, provided that, to the extent that the statute permits Techtronic Industries
Australia Pty Ltd and Techtronic Industries New Zealand Limited to limit its liability for a breach of a condition or a warranty implied by that statute,
Techtronic Industries Australia Pty Ltd and Techtronic Industries New Zealand Limited liability for such a breach will be limited to, at Techtronic Industries
Australia Pty Ltd and Techtronic Industries New Zealand Limited election, the repair or replacement of the goods or payment of the cost of the repair or
replacement.
4. Under this Warranty:
a) The product defects covered by this warranty will be repaired, during normal business hours at the premises of Techtronic Industries Australia Pty
Ltd, Techtronic Industries New Zealand Limited or the authorised service centre. Without cost to the owner for parts and repair labour or, at the
option of Techtronic Industries Australia Pty Ltd, Techtronic Industries New Zealand Limited will be replaced.
b) The owner is responsible at all times for freight costs and insurance costs if the Product has to be returned for repair/inspection to Techtronic
Industries Australia Pty Ltd, Techtronic Industries New Zealand Limited or the authorised service centre.
5. For repair under this Warranty:
a) The owner must present the sales docket receipt to the authorised service centre.
b) For Service in Australia the customer should contact the Australian Customer Support line on 1300 557 442 to obtain the nearest authorised service centre.
c) For Service in New Zealand the customer should contact the New Zealand Hotline Application on 0800 279 624 to obtain the nearest authorised
service centre.
