prior to expiration of the Warranty Period, and within thirty (30)
days of discovery of the defect. Upon MedDex Solutions' written
request and authorization, Purchaser shall return the Product to
MedDex Solutions, for inspection.
MedDex Solutions will not be responsible for damage due to
improper packaging or shipment.
C) Except as provided in paragraph 9.b.A), above, the Product is
being sold “AS IS”, all accessories are sold “AS IS”, and the
entire risk as to the quality and performance of the product is with
Purchaser. The Warranty provided in the paragraph 9.b.A),
above,
Purchaser
and MedDex Solutions disclaims all other Warranties of
Merchantability and Fitness for a particular purpose; provided,
however, that, not withstanding the foregoing sentence, in the event
an implied Warranty is determined to exist, the period for the
performance by MedDex Solutions there under shall be limited to
the one (1) year of the initial Purchaser. No employee, representative
or agent of MedDex Solutions has any authority to bind MedDex
Solutions to any affirmation, representation or warranty except as
stated in this written warranty policy.
B) Purchaser is responsible for shipping and handling, including
proper mail insurance and/or delivery confirmation. This Warranty is
voided immediately as to any Product which has been attempted to
be repaired or modified by any person other than authorized
employees/agents of MedDex Solutions or which has been subjected
to misuse, abuse, neglect, damage, whether while in possession of
Purchaser or in transit, accident or negligence.
