Limited Warranty and Disclaimer
a. Warnin
g:
While it is the opinion of MedDex Solutions, LLC, (MedDex
Solutions) that the use of the DeXtra TENS (the Product) has
resulted in the successful relief of chronic pain, MedDex Solutions
makes no warranties to the Purchaser as to the effectiveness of the
product.
b. Warranty:
A) MedDex Solutions warrants to the initial Purchaser
(“Purchaser”) (and to no other person) that the Product, including
any new or factory reconditioned products, but excluding any
accessories such as chargers, batteries, electrodes, leadwires,
skin prep, skin gels, and skin creams, and the component parts
thereof, distributed or manufactured by MedDex Solutions,
shall be free from defects in the workmanship and materials
for the period of one (1) year. The applicable warranty period will
be measured from the date the Product is delivered to the
Purchaser.
B) Accessories including, but not limited to, chargers,
batteries, electrodes, leadwires, skin prep, skin gels, and skin
creams are excluded from the warranty and are sold "AS IS".
c. Limitation of Liabilities and Disclaimer of
Warranties:
A) MedDex Solutions’ sole obligation in case of any breach
of its warranties set forth in paragraph 9.b.A)
above, shall be, at
MedDex Solutions’
Product with a
factory reconditioned Product without charge to the
