Limitations:
• If Gateway is unable to repair or replace parts for your Gateway product for any reason, Gateway may, at its option
AND ONLY ONCE DURING THE PROTECTION PERIOD, replace your Gateway product with a new or serviceably
used Gateway product, comparable in function and performance to your Gateway product. In any event, Gateway’s
maximum liability to you under this Plan will not exceed the original purchase price of your Gateway product.
• This Plan is not an insurance policy.
• You may not assign or transfer this Plan. This Plan terminates when you transfer or dispose of your Gateway product.
You may not renew or extend this Plan.
• You may cancel this Plan for any reason at any time. To cancel, you must send written notice to: Gateway Service
Contract Cancellation, Customer Service Department, 610 Gateway Drive, North Sioux City, SD 57049. Unless
otherwise specified under applicable law, if you cancel within 30 days after you received this Plan, Gateway will issue a
full refund of the Plan purchase price less the cost of parts/services provided during the first 30 days (the “30-Day
Refund”). If Gateway fails to pay you the 30-Day Refund within 45 days of your cancellation of this Plan and the Plan is
deemed void under applicable law, you may also be entitled to a monthly penalty equal to 10% of the Plan purchase
price in addition to the 30-Day Refund. If you cancel after 30 days, Gateway will refund a pro rata portion of the Plan
purchase price based on the time expired (measured on a weekly basis) less a cancellation charge of $25 or 10% of the
Plan purchase price (whichever is less), and less the cost of any parts/services actually provided to you prior to
cancellation. Gateway cannot cancel this Plan except for fraud, material misrepresentation or non-payment by you; or if
required to do so by a regulatory authority. If Gateway cancels this Plan, Gateway will give you 30 days advance notice
and refund a pro rata portion of the purchase price based on the time expired (measured on a weekly basis) less the
cost of any parts/services actually provided to you prior to cancellation.
• This Plan is not available in all jurisdictions. Please refer to your invoice to determine whether this Plan applies to you.
• If you request service outside the United States, the level of service available to you may vary. In particular, you may
be required to pay shipping costs to and from Gateway to obtain service. Please refer to Gateway’s Standard Terms
of Sale and Limited Warranty Agreement for more information.
Financial Assurance:
Unless otherwise required by applicable law, this Plan is not insured under any reimbursement insurance policy.
Gateway Country Stores LLC, 610 Gateway Drive, North Sioux City, South Dakota 57049, is the administrator and
obligor of this Plan in all jurisdictions except Wisconsin, in which Gateway, Inc., 610 Gateway
Drive, North Sioux City, South Dakota 57049, is the administrator and obligor of this Plan. Obligations of Gateway
Country Stores LLC under this Plan are backed by the full faith and credit of Gateway, Inc.
GATEWAY WILL PROVIDE THE SERVICES ON THE TERMS DESCRIBED ABOVE AND THE TERMS IN GATEWAY
STANDARD TERMS OF SALE AND LIMITED WARRANTY AGREEMENT (SET FORTH ON PAGE 11 OF THIS
BOOKLET AND ALSO AVAILABLE AT HTTP://WWW.GATEWAY.COM/), WHICH TOGETHER ARE THE COMPLETE
AGREEMENT BETWEEN YOU AND GATEWAY FOR THE SERVICES YOU HAVE PURCHASED. UNLESS THIS
PLAN SPECIFIES OTHERWISE OR PROVIDES TERMS INCONSISTENT WITH GATEWAY STANDARD TERMS OF
SALE AND LIMITED WARRANTY AGREEMENT, ALL THE TERMS OF GATEWAY STANDARD TERMS OF SALE
AND LIMITED WARRANTY AGREEMENT ARE INCORPORATED INTO THIS PLAN BY REFERENCE.
Special State Laws
FOR RESIDENTS OF CONNECTICUT ONLY:
You should note that under Regulations of Connecticut State Agencies §42-260-3, Gateway and you are required to
make reasonable efforts to resolve disputes regarding this Plan. If Gateway and you cannot reach an agreement, your
may file a written complaint with the State of Connecticut Insurance Department, P.O. Box 816, Hartford, CT 06142-
0816, Attn: Consumer Affairs.
FOR RESIDENTS OF FLORIDA ONLY:
• GATEWAY, INC. D/B/A GATEWAY COMPUTERS, INC. IS THE ADMINISTRATOR AND OBLIGOR OF THIS PLAN.
• GATEWAY, INC. D/B/A GATEWAY COMPUTERS, INC. has retained Gateway Country Stores, LLC located at 610
Gateway Drive, North Sioux City, South Dakota 57049 as its sales representative in Florida.
• If GATEWAY, INC. D/B/A GATEWAY COMPUTERS, INC. cancels within 30 days after you received this Plan,
GATEWAY, INC. D/B/A GATEWAY COMPUTERS, INC. will issue a full refund of the Plan purchase price. If
GATEWAY, INC. D/B/A GATEWAY COMPUTERS, INC. cancels this Plan any time after 30 days, GATEWAY, INC.
D/B/A GATEWAY COMPUTERS, INC. will refund a pro rata portion of the purchase price based on the time expired
(measured on a weekly basis).
