Product warranty
DayStar Digital, Inc. warrants that for no additional charge it will repair or
replace, at its option, any defective products properly returned to our factory
for a period o f THREE (3) FULL YEARS from the date the product is purchased
by the original enduser.
This warranty does not apply if the hardware product has been damaged by
accident, misuse, abuse, installed with non-compatible products, modified in
any way or if the serial number has been removed or defaced. This warranty
does not apply to damage or failure o f the host com puter pow er supply, analog
and/or CPU logic board or any other add-in boards. This warranty is extended
only to original endusers.
THE GUARANTEE, WARRANTY AND REMEDIES SET FORTH ABOVE ARE EXCLU
SIVE AND IN LIEU OF ALL OTHERS, ORAL OR WRITTEN, EXPRESS OR IMPLIED.
DAYSTAR IS NOT RESPONSIBLE FOR SPECIAL, INCIDENTAL OR CONSEQUEN
TIAL DAMAGES RESULTING FROM ANY BREACH OF WARRANTY OR UNDER
ANY LEGAL THEORY, INCLUDING BUT NOT LIMITED TO LOST PROFITS,
DOWNTIME, GOODWILL, DAMAGE TO OR REPLACEMENT OF EQUIPMENT AND
PROPERTY AND ANY COSTS OF RECOVERING, PROGRAMMING OR REPRODUC
ING ANY PROGRAM OR DATA STORED OR USED WITH DAYSTAR PRODUCTS.
DAYSTAR DIGITAL, INC. OR ITS LICENSOR MAKES NO WARRANTIES, EITHER
EXPRESS OR IMPLIED, REGARDING THE ENCLOSED COMPUTER SOFTWARE
PACKAGE, ITS MERCHANTABILITY OR ITS FITNESS FOR ANY PARTICULAR
PURPOSE. THE EXCLUSION OF IMPLIED WARRANTIES IS NOT PERMITTED IN
SOME STATES. THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. THIS WAR
RANTY PROVIDES YOU WITH SPECIFIC LEGAL RIGHTS. THERE MAY BE
OTHER RIGHTS THAT YOU MAY HAVE WHICH VARY FROM STATE TO STATE.
