LIMITED WARRANTY - TARTAN YACHTS
Tartan Yachts warrants to the original purchaser of each new sailboat manufactured by Tartan
that:
Item 1. The boat and all parts manufactured by TARTAN will be free from defects in material and
workmanship under normal use and service and with normal care and maintenance for
a period of 12 months from the date of delivery or two years after the date of
manufacture, whichever comes first, to the original purchaser, and
Item 2. The chain plates, mast step and floor timbers will be free from structural defects
in material and workmanship under normal use and service for 10 years provided
that the boat has not been in charter or commercial use.
Item 3. The below-the-water gel coat surfaces of the hull will be free from osmotic
blistering for a period of 15 years after the boat is delivered to the original
purchaser for a period of 15 years after the boat is manufactured, whichever
occurs first. The keel and rudder are painted finishes and will require annual
maintenance.
Where and how warranty claims are made:
1.
Warranty claims must be made by the original purchaser through an authorized
Tartan dealer within 30 days after discovery of the defect. Dealers - please
forward warranty claims to Tartan Yachts, Attention: George Gulden.
2.
Approval from the factory must be granted before reimbursement will be made.
3.
TARTAN shall have the right to inspect the boat to determine the validity of the
claim and the nature of the defect. Such inspection may involve taking a core
sample of laminate.
4.
When a warranty claim is valid, Tartan or its purchased part(s) shall have the
option of either replacing or repairing the part. Hence, this may require that
the part be returned for repair or replacement to Tartan or its original manufacturer.
5.
Instead of repairing or replacing a defective hull of a boat no longer in production,
Tartan may, at its option, pay the original purchaser an amount equal to fifty
percent (50%) of the lesser of (a) the current (time of claim) fair market value
or (b) the original purchase price of the boat.
6.
Any claim for reimbursement of the cost of repairs authorized by Tartan shall
be submitted promptly upon the completion of such repairs using the standard
Tartan Yachts claim form available from either the dealer or Tartan Yachts.
Items not covered:
1.
Paints, varnishes, gel coats, chrome-plated or anodized finishes and other
surface coatings other than as specifically described in item three of the
warranty.
2.
Equipment and accessories not manufactured by Tartan Yachts, including
engines, pumps, batteries, deck hardware, rigging, heating, refrigeration,
plumbing and/or electronic equipment. (Such items, although installed by
Tartan or an authorized dealer, may be covered in warranties extended by
the original manufacturer.
