Under no circumstances will Sound World Solutions have any liability or obligation whatsoever for consequential, indirect,
incidental, special or punitive damages, including damages for loss of profit, damage to property or personal injury (including
loss of consortium), whether based on contract, tort (including negligence and strict liability) or otherwise. Sound World
Solutions’ only obligation and Customer’s exclusive remedy shall be limited to repair or replacement of the defective Product
subject to the terms of this limited warranty.
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM
JURISDICTION TO JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED
WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE
ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
Dispute Resolution:
SOUND WORLD SOLUTIONS AND CUSTOMER HERETO HEREBY ABSOLUTELY, IRREVOCABLY AND
UNCONDITIONALLY WAIVE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL RIGHT TO TRIAL BY JURY OF ANY
CLAIM OR CAUSE OF ACTION BASED UPON OR ARISING OUT OF OR RELATING TO THIS LIMITED WARRANTY IN ANY ACTION,
PROCEEDING OR OTHER LITIGATION OF ANY TYPE BROUGHT BY SOUND WORLD SOLUTIONS OR CUSTOMER AGAINST EACH
OTHER WHETHER WITH RESPECT TO CONTRACT CLAIMS, TORT CLAIMS, OR OTHERWISE.
