3. Irrespective of the provisions under 2, insofar as the one
electrical product, that applies with with regard to the
battery that is part of the product, Warranty is only given
in the event of a malfunction or the non-functioning of
the battery when this is demonstrable is the direct result
of material or manufacturing defects. A malfunction or
non-functioning of the battery as a result of normal wear
and tear is not covered by the warranty as intended in these
warranty conditions. Nor under warranty fall defects or
non-functioning that are the result of improper or improper
use of the product or the battery that is part of the product,
including the incorrect charging of the battery and the
inability to timely and to perform correct maintenance,
in whatever context of applies that if the Customer is a
Dealer, this Dealer Scoozy indemnifies against any claims
from Users or other third parties based on the above said
improper or improper use of it product or the battery that is
part of the product.
4. The warranty conditions as stated in the above provisions
will lapse if:
a. the Scoozy guidelines for product maintenance have not
been followed or have not been followed up sufficiently;
b. is a necessary repair or replacement of parts based on
neglect, damage or misuse of the product or a use of the
product for another purpose beyond that for which it was
intended;
c. parts of the product have been replaced by parts from other
sources than those used by Scoozy and / or parts of the
product have been replaced without the permission from
Scoozy.
5.
The guarantees, as stated in provisions 1 to 3, expire also
in the case of reuse by a new user within the warranty
period and when such reuse product adjustments required
and those adjustments have not been performed on the
instructions of and / or on behalf of Scoozy.
