PYROLITIC OUTDOOR HEATERS “RUBINO” AND “DIAMANTE”
are pellet driven and therefore are not covered by the following supranational statutory
provisions:
• Directive 2014/35/ EU on electrical equipment with voltage limits and Directive 2014/30/EU
on electromagnetic compatibility as the Heaters are not in need of any electrical supply;
• Regulation eu No 305/2011 305/2011 stipulating harmonised conditions for the marketing
of construction products and repealing Council Directive 89/106/EEC whereas Indoor pellet
driven ovens come under this law.

Art. 117 Defective Product:
1. A product is said to be defective if it does not provide the safety that a person is entitled
to expect. Thereto appertain in particular:
a) the way in which the product was put in circulation, its description, its overtcharacteri -
stics, the provided instructions and indications;
b) the usage of the product and behavior patterns that justifiably could be expected;
c) the point in time at that the product was put in circulation.
2. A product could not be considered as being defected solely because a better product
was put in circulation in some time.
3. A product has to be considered as being defected if it does not offer the security that
other products of this type normally offer.
