Maxell AirStash Product Limited Warranty
Limited Warranty
Maxell Corporation of America (“
Maxell ”) warrants to the original purchaser Maxell’s AirStash
A02 product (the “ Product ”) that, for a period of one (1) year from the date of sale to the original
purchaser (the “ Warranty Period ”), as specified in the Product documentation, each Product (a)
will function properly under normal use, (b) will be free from defects in material or
workmanship, and (c) will conform to the performance specifications applicable to the Product
and set forth in the Product documentation. An AirStash Product that satisfies each of these
conditions is called a “
Conforming Product ”. An AirStash Product that fails to satisfy any one
or more of these conditions is called a “ Non-Conforming Product ”.
Warranty Exclusions
This Maxell product warranty does
not apply to any Product failure caused by (a) casualty,
accident, abnormal use, misuse, abuse, neglect, or acts of God, or (b) Product damage caused by
improper packaging during transport after purchase, unreasonable handling, electrostatic
discharge, Product exposure to heat or humidity in excess of the temperature conditions set forth
in the Product specifications, or improper installation, operation or maintenance, or
(c) any
Product alteration or modification without the written permission of Maxell, or (d) failure to
follow any Product instructions provided by Maxell. The Maxell product warranty also does not
apply to any Product that has been tampered with in any manner. The Product contains an
internal lithium polymer battery which is neither serviceable nor replaceable. Any attempt to
remove, replace, or gain access to the internal battery will immediately void the product
warranty.
Warranty Disclaimer
EXCEPT FOR THE EXPRESS MAXELL PRODUCT WARRANTIES SET FORTH ABOVE
UNDER “LIMITED WARRANTY”, NEITHER MAXELL NOR ANY OF ITS DEALERS
MAKES, AND EACH OF MAXELL AND ITS DEALERS EXPRESSLY DISCLAIMS, ANY
AND ALL OTHER WARRANTIES WITH RESPECT TO THE PRODUCT, INCLUDING,
BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE.
Exclusive Remedy
If, during the Warranty Period, any Product is a Non-Conforming Product and the cause of the
non-conformity is not excluded under “Warranty Exclusions” and if this Product nonconformity
is reasonably confirmed by Maxell upon inspection, Maxell, at its expense, will repair the Non-
Conforming Product or, in its sole discretion, replace the Non-Conforming Product with a
Conforming Product, and will return to you the repaired or replacement Product. Each
Replacement Conforming Product will be under the “Limited Warranty” as set forth above for a
period of ninety (90) days from the date of receipt by the original purchaser of the replacement
Product or for the remainder of the original Warranty Period,
whichever is longer .
