GPSI LIMITED WARRANTY FOR VISAGE GPS UNITS
INTRODUCTION
GPS Industries LLC (“GPSi”) hereby warrants to the Original Purchaser or Lessee/Licensee
(“Customer”) and subject to the provisions, limitations and exclusions in this limited warranty, that the
Visage GPS unit purchased, leased, or licensed from GPSi, an Authorized Dealer or Authorized
Distributor shall be free from defects in material and workmanship under normal use and service,
subject to the provisions, limitations and exclusions in this limited warranty.
Provided that the System is maintained properly pursuant to Customer’s obligations set forth herein,
GPSi warrants, and subject to the provisions, limitations, and exclusions in this limited warranty, that
the Visage GPS unit will provide distance measurements within established performance parameters
pertaining to system components when the system is operated under conditions that are typically
encountered on a golf course, specifically but without limitation: clear access to satellites and
reasonably clear weather with temperatures between 32 °F (0 °C) and 120 °F (48.9 °C). Customer
acknowledges that GPS-produced distances are subject to a margin of error. Customer further
acknowledges that terrain and topography affect the margin of error on a particular GPS receiver and
that the margin of error may be increased under certain topographical conditions.
This limited warranty covers material, workmanship and repair labor cost as to those items specifically
listed below for the periods specified. Such repair labor shall be performed only by GPSi, its authorized
dealers or distributors, or a service agency approved by GPSi. For repairs made by qualified
technicians other than GPSi’s factory technicians or an authorized dealer or distributor, GPSi will
provide only the replacement parts or components.
EXCLUSIONS
Excluded from any GPSi warranty is damage to the unit or component resulting from a cause other
than a defect including poor maintenance, neglect, abuse, accident and collision, maintenance
adjustments, unreasonable or unintended strain or use, improper installation of accessories (such as
connecting any accessories to less than the full pack of batteries), installation of parts or accessories
that are not original equipment including non-approved GPS systems, non-approved alteration and
acts of God.
In addition to the foregoing, the provisions of this limited warranty shall not apply to failure due to the
following conditions:
1. maintenance, repair or replacement of parts damaged or failing to operate due to acts of God,
including without limit storms, atmospheric disturbances, lightning, fire, hail, and flood; acts of
government, including war; catastrophes, accident, neglect, misuse, failure of satellites, failure of
electrical power, fault or negligence of Customer;
2. causes external to the System or from any other cause beyond the control of GPSI;
3. service and repair of accessories, attachments, or any other devices that are not part of the
System;
4. changes, modifications or alterations in or to the System required due to new construction or
changes to the golf course or facilities;
5. graphical changes after acceptance of the System;
6. software damage caused by unauthorized use.
Without limiting the generality of the foregoing in any way, and as part of its limited warranty
exclusion, GPSi does not warrant that the GPS unit or components are suitable for use in any
application other than in its products. As in the use of any vehicle, batteries, computer, controller or
electrical device, a prudent owner or lessee will read and study the owner’s manual, the operator
instructions and the warning labels; and will exercise due care in working on or around vehicles,
batteries or electrical devices.
