above or continued use of the Product shall constitute an
unqualified acceptance of such Product and a waiver by
Purchaser of all claims thereto.
3. EXCEPTIONS TO LIMITED WARRANTY: This Limited Product
Warranty only covers product issues caused by defects in material
or workmanship during ordinary consumer use. Adphox shall
have no liability or obligation to Purchaser with respect to any
Product requiring service during the Warranty Period which is
subjected to any of the following: abuse, improper use; product
issues due to commercial use; negligence, accident, modification,
failure of the end-user to follow the operating procedures outlined
in the Instruction Manual, failure of the end-user to follow the
maintenance procedures in the Instruction Manual for the
Product where a schedule is specified for regular replacement or
maintenance or cleaning of certain parts (based on usage) and the
end-user has failed to follow such schedule; attempted repair by
non-qualified personnel; damage due to smoke exposure (cigarette
or otherwise); operation of the Product outside of the published
environmental and electrical parameters, or if such Product's
original identification (trademark, serial number) markings have
been defaced, altered, or removed. Adphox excludes from
warranty coverage Products sold AS IS and/or WITH ALL
FAULTS and excludes used Products which have not been sold by
Adphox to the Purchaser.
4. CUSTOMER DATA: Purchaser shall be solely responsible for
maintaining backup data necessary to replace Purchaser data lost
or damaged from any cause.
5. PROOF OF PURCHASE: The Purchaser's dated bill of sale shall
be retained as evidence of the date of purchase and to establish
warranty eligibility.
LIMITATION ON DAMAGES: ADPHOX SHALL NOT BE LIABLE
FOR ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR
BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON
THIS PRODUCT, EITHER DURING THE WARRANTY PERIOD
OF AFTER EXPIRATION OF THE WARRANTY PERIOD, OR
FOR ANY OTHER REASON WHATSOEVER.
DURATION OF IMPLIED WARRANTIES: EXCEPT TO THE
EXTENT PROHIBITED BY APPLICABLE LAW, ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A
PARTICULAR PURPOSE ON THIS PRODUCT IS LIMITED IN
DURATION TO THE DURATION OF THIS WARRANTY.
Some states do not allow the exclusion or limitation of incidental
or consequential damages, or allow limitations on how long an
implied warranty lasts, so the above limitations or exclusions
may not apply to Purchaser. This Limited Product Warranty gives
Purchaser specific legal rights and Purchaser may have other
rights which vary from states to state.
