WARRANTY POLICY
AcuRite is a wholly owned subsidiary of Chaney
Instrument Company. For purchases of AcuRite products
from one of our official retailers, AcuRite provides the
benefits and services set forth herein. For purchases
of Chaney products from one of our official retailers,
Chaney provides the benefits and services set forth
herein. The benefits given by this warranty policy are
in addition to your statutory rights in relation to your
product(s) and those rights are not affected by this
policy. For further information about your statutory
rights contact your local authority Trading Standards
Department of Citizens’ Advice Bureau.
Important Information
Our products are sold by our official retailers and subject to
your legal rights. This policy is in addition to, and not instead
of, those legal rights. You are entitled to a replacement or
refund for a major failure and may be entitled to compensation
for any other reasonably foreseeable loss or damage. Loss
is foreseeable where it could be contemplated by you and us
at the time the goods are supplied. You are also entitled to
have the goods repaired or replaced if the goods fail to be of
acceptable quality and the failure does not amount to a major
failure. This does not affect your statutory rights. For further
information about your statutory rights contact your local
authority Trading Standards Department of Citizens’ Advice
Bureau.
We expressly disclaim all liability for any loss or damage,
whether arising in tort/delict or by contract from any breach of
this warranty which is an indirect loss which happens as a side
effect of the main loss or damage and which is not foreseeable
by you or us; for any loss or damage not caused by us; and
for any loss or damage to business or non-consumers. By
acceptance of any of our products, the purchaser assumes all
liability for the consequences arising from their misuse. No
person, firm or corporation (other than our duly authorized
agent) is authorized to bind us to any other obligation
or liability in connection with the sale of our products.
Furthermore, no person, firm or corporation (other than our
duly authorized agent) is authorized to modify or waive the
terms of this warranty unless done in writing and signed by a
duly authorized agent of ours.
Applicability of Policy
This Return, Refund, and Warranty Policy applies only to
purchases made in the UK. For purchases made in a country
other than the UK, please consult the policies applicable to the
country in which you made your purchase.
Additionally, this Policy applies only to the original purchaser
of our products. We cannot and do not offer any return, refund,
or warranty services if you buy products used or from resale
sites such as eBay or Craigslist.
If any term is held to be unenforceable, it shall be excluded
from the warranty and the legality and enforceability of the
remaining terms shall not be affected.
Governing Law
This Return, Refund, and Warranty Policy is governed by the
laws of the laws of England unless you live in Scotland in
which case the laws of Scotland will apply. Any dispute relating
to this Policy shall be brought in the relevant court of the part
of the United Kingdom which has jurisdiction, for example –
where you reside.
