Handling Precautions

1. Always handle the drive with care to prevent damage from shock, vibration or electrostatic

discharge (ESD).

2. Do not open the static-protective bag containing the drive until required.  Static electricity

can damage the drive.

3. Turn off and unplug your computer before removing the case.

4. When you are installing the drive, touch the static-protective package containing the drive

to a grounded, unpainted metal surface for at least two seconds.  (This drains static electricity

from the package and from your body.

)

5. Handle the drive carefully by the edges.  Do not touch any exposed printed circuit board.

6. Save your drive packaging materials including the 

ESD

 bag in the event the drive has to be

returned.  Place the drive in an anti-static bag before placing it in the shipping container.  The

warranty will be void if the drive is not returned in IBM approved packaging.

Statement of Limited Warranty

Warranty Period:

  

3 Years

The end user Warranty Period starts on the date that the Product is first purchased by an end

user customer.  The end user warranty ends on the earlier of:

      - the start date plus the Warranty Period, or

      - 9 months after date of original shipment by  IBM to an IBM Authorized Distributor plus the

         applicable Warranty Period. 

The warranties provided by IBM in this Statement of Limited Warranty apply only to Products

which were originally sold in the United States by IBM to an IBM Authorized Distributor, and

which the end user originally purchases for his/her own use and not for resale. Under this

Limited Warranty, IBM will ship Replacement Products only to locations in the United States

THE IBM WARRANTY

Each product is manufactured from new parts, or new serviceable used parts (which perform

like new parts). IBM warrants that each Product is free from defects in materials and

workmanship during the Product’s applicable Warranty Period. You should keep your original

invoice as your proof of purchase, which will be required to validate the warranty status of the

Product. 

During the Warranty Period, you may return the Product, freight prepaid, to IBM or your

reseller

 for replacement if the Product is not as warranted. Upon receiving the returned

Product from you, IBM will send you a Replacement Product. This is IBM’s entire obligation to

you regarding your warranted Product. The Replacement Product may not be new, but will be

in good working order and at least functionally equivalent to the item replaced. The warranty

period on the Replacement Product will end on the later of:

   

 - the end date of the warranty on the returned Product, not to exceed 3 months  after  the      

       original shipment date by IBM to an IBM authorized Distributor plus the  Warranty Period    

       on  the returned Product; or

    - ninety (90) days. 

If the Replacement Product fails during its warranty period, IBM will replace it with another one.

WARRANTY SERVICE

To obtain warranty service from IBM for the Product , call IBM at 

888.IBM.5214

 for technical

assistance and to obtain a Return Material Authorization 

(RMA)

 number. You may be asked to

perform specific problem determination procedures in order to verify the failure. Upon

verification of the failure, the Product must be returned to IBM 

 according to IBM’s return

instructions. IBM will send you a Replacement Product, freight prepaid. The Replacement

Product becomes your property; the replaced Product becomes IBM’s property.

EXTENT OF WARRANTY

IBM does not warranty uninterrupted or error-free operation of a Product.   Misuse, accident,

modification, unsuitable physical or operating environment, improper maintenance by you, or

failure caused by a product for which IBM is not responsible may void the warranties. 

THESE WARRANTIES REPLACE ALL OTHER WARRANTIES, EXPRESS OR IMPLIED,

INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF NON-INFRINGEMENT AND

THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A

PARTICULAR PURPOSE.  HOWEVER, SOME LAWS DO NOT ALLOW THE EXCLUSION

OF IMPLIED WARRANTIES. IF THESE LAWS APPLY, THEN ALL EXPRESS AND

IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE WARRANTY PERIOD. NO

WARRANTIES APPLY AFTER THAT PERIOD.

Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above

limitations may not apply to you.

LIMITATION OF LIABILITY

Circumstances may arise where, because of a default on IBM’s part (including fundamental

breach) or other liability (including negligence and misrepresentation), you are entitled to

recover damages from IBM. In each such instance, regardless of the basis on which you are

entitled to claim damages, IBM is liable only for:

    

 1.  bodily injury (including death), and damage to real property and tangible personal              

          p

roperty; and

     2.  the amount of any other actual loss or  damage, up to the greater of $10,000 or the         

             c

harge for the Product that is the subject of  the claim.

Under no circumstances is IBM liable for any of the following:

     1.  third-party claims against you for losses or  damages (other than those under  the first    

          item listed above); 

     2.  loss of, or damage to, your records or data; or

     3.  economic consequential damages (

including

 lo

s

profits or savings) or incidental              

          d

amages, even if IBM is informed of their possibility.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential

damages, so the above limitation or exclusion may not apply to you.

This warranty gives you specific legal rights and you may also have other rights which vary

from jurisdiction to jurisdiction.
