Hardware Warranty Coverage
Looxcie, Inc. (1196 Borregas Ave, Suite 200, Sunnyvale, CA 94089), warrants the Looxcie video device (“Product”) to be free of material defects (subject to the
terms set forth below) for a period of one (1) year from the date of purchase (“Warranty Period”). Looxcie, Inc. warrants the Looxcie accessories to be free of
material defects (subject to the terms set forth below) for a period of 90 days from the date of purchase. This Warranty specifically excludes any Looxcie software
applications which are subject to separate End User License Agreements and any software embodied in the hardware. During the Warranty Period, Looxcie, Inc.
will repair or replace (at Looxcie, Inc.’s discretion) this Product or any defective parts (“Warranty Service”) at no charge (other than applicable incidental charges).
Replacement Product may be new or refurbished/recertified at Looxcie, Inc.’s discretion. If repair or replacement is not commercially practical or cannot be timely
made, Looxcie, Inc. may choose to refund the purchase price paid for the affected Product. Customers should visit www.looxcie.com/support for instructions
regarding obtaining Warranty Service.
If Looxcie, Inc. provides service under Warranty, the terms of the Warranty and applicable provisions of law will cover defects in materials and workmanship that
arise during the remaining Warranty or 90 days after service, whichever provides longer coverage. If service is provided outside of Warranty, Looxcie, Inc. warrants
that the replacement will be free from defects in materials and workmanship for 90 days from the replacement ship date.
This Warranty is only valid for the original purchaser with the original purchase receipt and will automatically terminate prior to expiration if this Product is sold or
otherwise transferred to another party.
The Warranty provided by Looxcie, Inc. in this statement applies only to new Products purchased for use, and not for resale. It does not apply to open box purchases
or refurbished Products, which are sold “as is” and are not covered by this Warranty. Specifically exempt from Warranty are limited-life consumable components
subject to normal wear and tear, such as earbuds and earloops.
This Warranty does not cover cosmetic damage or damage due to misuse, abuse, negligence, acts of nature, accidents, disassembling, or modification of or to any
part of the Product. This Warranty excludes damages resulting from actions not Looxcie Inc.’s fault and damages resulting from the use of non-Looxcie products.
This Warranty does not cover lost data, files, clips, or video. This Warranty does not cover damage due to improper operation, maintenance, or installation,
or attempted repair by anyone other than Looxcie, Inc. or a Looxcie dealer authorized to do Looxcie Warranty work. Any unauthorized repairs will void this Warranty.
WARRANTY IS EXCLUSIVE REMEDY OF CONSUMER. ALL STATUTORY OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY
AND FITNESS FOR A PARTICULAR PURPOSE, SHALL BE LIMITED TO THE DURATION OF THIS EXPRESS WARRANTY. IN NO EVENT SHALL LOOXCIE, INC. BE LIABLE,
WHETHER IN CONTRACT OR TORT, FOR DAMAGES IN EXCESS OF THE PURCHASE PRICE OF THE PRODUCT OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR
CONSEQUENTIAL DAMAGES OF ANY KIND OR LOSS OF INFORMATION ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE PRODUCT(S), TO THE
FULL EXTENT THESE DAMAGES MAY BE DISCLAIMED BY LAW.
