The recommendations and suggestions regarding product application and use that are offered on Toycen websites, in our
product brochures, or information provided by any employee, broker or distributor of Toycen products, are a guide in the
use of this product and are not a guarantee to their performance since Toycen has no control over the use that parties may
apply the product. Toycen recommends that operators and users of our products ensure that the intended use does not
violate any Federal, State/Provincial, or Local laws; are within the described performance characteristics of the product, all
Federal, State/Provincial workplace safety requirements are being complied with, and any product specific safety require-
ments are met. Meeting the above requirements is the sole responsibility of the user/operator of the product.
This Toycen product is designed, and intended, solely for the purpose of the removal of metal by grinding though the use
of a rotating, abrasive coated wheel. It is not intended or designed for any other purpose. The product buyer, assign-
ee, transferee and or user agree to use the Product for its intended purpose and designed use. This product is warranted
against any manufactured defect for a period of 12 months from the original date of purchase.
The user agrees to ensure, and is solely responsible for ensuring, the proper, legal, and safe use of the Product. Use of the
Product is at the sole risk and discretion of the user. EXCEPT AS EXPRESSLY PROVIDED HEREIN , AND TO THE
GREATEST EXTENT PROVIDED BY APPLICABLE LAW, THIS PRODUCT IS SOLD ON AN AS IS, WHERE AS, AND
WITH ALL FAULTS BASIS, AND TOYCEN DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, WHETHER
EXPRESS OR IMPLIED, RELATING TO THIS PRODUCT, INCLUDING WITHOUT LIMITATION ANY IMPLIED
WARRANTY OF MERCHANTABILITY, ANY IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE,
ANY WARRANTY AS TO THE SAFETY OF THE PRODUCT, OR ANY WARRANTY MADE BY ANY DISTRIBUTOR
OR OTHER THIRD PARTY. ANY WARRANTY DETERMINED TO BE GIVEN BY TOYCEN IS CONDITIONED
UPON THE USER’S COMPLIANCE WITH THIS TERMS OF USE & DISCLAIMER.
To the greatest extent provided by applicable law, the user, for himself/herself/itself and his/her/its heirs, personal repre-
sentatives, successors, and assigns, hereby releases, discharges, indemnifies, and holds harmless the product seller, manu-
facturer, designer and their agents, affiliates, successors, and assigns Toycen from any and against any and all claims, causes
of action, damages, injuries, loss of profits, loss of business, expenses, attorney’s fees, and harm of any kind, whether or
not foreseeable, directly or indirectly relating in whole or part to the use or installation of this product in violation of the
terms and conditions of this Terms of Use & Disclaimer, any Toycen product manual, directions, warnings or instructions,
and applicable law, any use of this product in violation of the terms and conditions of this Terms of Use & Disclaimer and
applicable law, and any other use of this product, regardless of the acts or omissions, whether negligently or otherwise
occurring. To the greatest extent provided by applicable law, Toycen will not be liable for, and the user waives any right to
seek against Toycen any consequential, indirect, special, statutory, exemplary, punitive, or incidental damages caused by the
installation or use of this product, and the liability of Toycen in the aggregate will be limited to the standard retail purchase
price of this product since the price stated for this product is a consideration in limiting Toycen’s liability.
All Toycen products are industrial/commercial grade and as such it is understood product users are familiar with industrial
and commercial equipment, their uses and limitations, required safety equipment, policies, and procedures.
User acknowledges that activities involving potential uses of this product may be result in personal injury. Installation
or other use of this product constitutes the user’s acknowledgement that the user has read and understands the warnings,
cautions, and Terms of Use & Disclaimer and that the user agrees and consents to the terms and conditions of this Terms of
Use & Disclaimer; OTHERWISE, DO NOT INSTALL OR USE THIS PRODUCT.
