EQUIPMENT WARRANTY
ByoPlanet warrants the original purchaser of any ByoPlanet
®
Electrostatic Spray System that the equipment shall be free from
defects, material and workmanship, for a period of one year after
the date of delivery.
Disclaimer of Implied Warranties and Consequential Damages
The ByoPlanet obligation under this warranty, to the extent allowed by
law, is in lieu of all warranties, implied or expressed, including implied
warranties of merchantability and fitness for a particular purpose and
any liability for incidental and consequential damages with respect to
the sale or use of the items warranted.
Such incidental or consequential damages shall include, but are not
limited to: transportation, charges other than normal freight charges,
cost of installation other than cost approved by ByoPlanet, duty, taxes,
charges for normal service or adjustments, loss of income, expenses
due to loss, damage, detention or delay in the delivery of equipment or
parts resulting from acts beyond the control of ByoPlanet.
THIS WARRANTY SHALL NOT APPLY TO:
1.
Defects, failures, damages or performance limitations caused in whole or
in part by:
a.
b.
Power failures, surges, accidents, actions of third parties, weather or
other acts of God, or
The product being subjected to abuse, mishandling, misuse,
negligence, improper storage, service or operation, or unauthorized
attempts to repair or alter the equipment in any way.
2.
Any product in which any chemical other than chemical sold by or on
behalf of ByoPlanet and expressly identified by ByoPlanet for use in such
product.
3.
Normal wear and tear.
NO EMPLOYEE OR REPRESENTATIVE OF BYOPLANET IS
AUTHORIZED TO CHANGE THIS WARRANTY IN ANY WAY OR
GRANT ANY OTHER WARRANTY UNLESS SUCH CHANGE IS
MADE IN WRITING AND IS SIGNED BY A CORPORATE
OFFICER OF BYOPLANET.
