iadesini, ayıp oranında bedel indirimini veya imkan varsa malın ayıpsız
misli ile değiştirilmesini satıcıdan talep edebilir. Satıcı, tüketicinin talebini
reddedemez. Bu talebin yerine getirilmemesi durumunda satıcı, üretici ve
ithalatçı müteselsilen sorumludur.
If it is made certain with a report issued by technical service, dealer,
manufacturer or importer that it is not possible to repair; consumer will be
entitled to claim for the refund of the product, price discount in proportion
to defect or replacement of the defective product with its equivalent, if
available. Dealer shall not be able to refuse the claim of consumer. Dealer,
manufacturer and importer shall be severally responsible in case of any
failure to fulfill such obligation.
Malın tamir süresi 20 iş gününü geçemez. Bu süre, garanti süresi içerisinde mala
ilişkin arızanın bölge servis birimleri veya satıcı bayiye bildirimi tarihinde, garanti
süresi dışında ise malın ilgili bölge servis ekiplerine teslimi veya ekipler tarafından
teslim alınması tarihinden itibaren başlar. Malın arızasının 10 iş günü içerisinde
giderilmemesi halinde, üretici ve ithalatçı; malın tamiri tamamlanıncaya kadar
benzer özelliklere sahip başka bir malı tüketicinin kullanımına tahsis etmek
zorundadır. Malın garanti süresi içerisinde arızalanması durumunda, tamirde geçen
süre garanti süresine eklenir.
If this period is outside the warranty period on the date when notice related to
defect within the warranty period, is made to the technical service, then it will start
as from the date when product is delivered to the technical service. Manufacturer
or importer shall be obligated to provide the consumer with another product with
similar features until the repair of the product is finalized in case the repair can not
be accomplished more than 10 days. In case the product becomes defective within
the warranty period, the period required to repair will be added to the warranty
term. Defects resulting from the use of product opposite to the instructions available
in the product user manual shall not be covered within the warranty scope. All the
defects that come to existence because of the misusage of the consumer are not
under the cover of warranty terms.
Tüketici, garantiden doğan haklarının kullanılması ile ilgili olarak çıkabilecek
uyuşmazlıklarda yerleşim yerinin bulunduğu veya tüketici işlemlerinin yapıldığı
yerdeki Tüketici Hakem Heyetine veya Tüketici Mahkemesine başvurabilir.
In case of disputes related to the rights arising from the warranty, consumer can
apply to Consumer Arbitration Committee and Consumer Courts in his placement
of residence or in which the consumer transactions are made.
Satıcı tarafından bu Garanti Belgesinin verilmemesi durumunda tüketici, Ticaret
Bakanlığı Tüketicinin Korunması ve Piyasa Gözetimi Genel Müdürlüğüne başvurabilir.
If the warranty document is not given to the consumer, he has the right to apply
to Ministry of Trade and Directorate General of Consumer Protection and Market
Surveillance.
