Warranty Information
KADEY-KROGEN YACHTS, INC.
LIMITED WARRANTY
Kadey-Krogen Yachts, Inc. (the “Seller”) warrants that the hull and superstructure of the
Yacht shall be free of defects in material and workmanship for a period of one (1) year
from date of delivery of Yacht to the Buyer, subject to extension to: (a) five (5) years
from the date of delivery of the Yacht to the Buyer, as to stringer systems, structural
bulkheads, and fiberglass laminates of molded pieces (including the hull, decks, liners,
and other molded parts) manufactured by the Seller; and (b) three (3) years from the date
of delivery of the Yacht to the Buyer, as to damage to the hull bottom’s gel coat surface
due to blistering resulting from defects in materials and workmanship, provided that the
gel coat surface has not been altered in any way (e.g., by sanding, sand blasting, or
applying a coating other than standard type anti-fouling paint). The Seller’s warranty
does not extend to any other equipment, parts, or components of the Yacht. The Seller,
however, to the extent possible and without recourse, shall assign to the Buyer, upon
request, all warranties, express or implied, received by the Seller from other
manufacturers and suppliers. This limited warranty extends only to the original buyer of
the Yacht. The Seller shall have no liability hereunder to any subsequent owner.
The Seller shall have the election to repair or replace any defective part or component
and shall furnish the labor for such corrective work. Any defective workmanship or
materials replaced or repaired pursuant to this warranty are warranted for the remainder
of the applicable warranty period. Parts and labor shall be furnished pursuant to this
warranty at the Seller’s facility, in Stuart, Florida; provided, however, that if it would be
impractical to return the Yacht to the Seller’s shipyard for repair, the Buyer, subject to
the Seller’s reasonable approval, may cause the necessary repairs to be made at other
available facilities, in which event the Seller will pay, or will reimburse the Buyer for
payment of, the costs or repair, such costs not to exceed the “retail” cost of parts and
labor that would have been incurred had the repairs been made at the Seller’s facility, or
alternatively, the Seller may require the Buyer to return the defective part or component
to the Seller, transportation charges prepaid, for repair. If the Yacht is transported to the
Seller’s facility or other location for warranty repair, the cost of transportation shall be
borne by the Buyer. The Buyer shall reimburse the Seller for any expenses the Seller
incurs in inspecting any asserted defect not covered under this limited warranty.
The warranty to repair and replace as set forth herein shall not extend to defects
attributable to:
(1) failure or damage arising from ordinary wear and tear; fire; owner or operator
abuse, neglect, or misuse; owner or operator negligence; accident; mishap; or
adverse weather or sea conditions in excess of those for which Yacht is designed.
