16. Warranty
1.
Beyond the liability of defects, iEXERGY guarantees the durability of wibutler
products, as long as they were installed by an iEXERGY certified craftsman, for 15
months, starting with the date of purchase. Warranty includes all construtional,
material and manufactural defects. Existing guarantee rights will not be affected
by this warranty contract.
2.
This warranty does not include defects/errors that refer to
a.
incorrect mounting or installation,
b.
disregard of installation or user manual, inappropriate operation or stress,
c.
external influences, such as collisions, hits or atmospheric conditions,
d.
third party or user changes or repairs,
e.
use of inappropriate accessory parts,
f.
defects caused by incorrect overvoltages, or
g.
malfunctions caused by frequency overlay or other.
3.
iEXERGY remedies deficiencies that occur within the warranty period by repairing
or replacing the concerned item or by delivering an equivalent or new device for
free. Repair or substitution due to warranty reasons do not implicate an extension
of the original warranty period.
4.
Later improvements or supplementary performances for the sake of good will, do
not implicate a restart of the legal warranty period, whereas a warranted notice
of defects and later improvement or subsequent delivery by iEXERGY implicate a
renewal of legal warranty.
5.
iEXERGY is not liable for financial loss due to temporary or permanent breakdown
of one or more usable servers or their unavailability caused by the affiliate, other
if breakdown or unavailability can be referred to a deliberate or grossly negligent
behaviour of iEXERGY. This especially applies to the loss of data.
