21.3. User Instructions for Entrepreneurs
Basic approac:
The mobile services GPSoverIP and DATAoverIP are used for the supervi-
sion of the own vehicle fleet and for the utilization of the determined data in the sense of
the enterprise and against violations of the enterprise regulations.
Attention must be paid to the following six points:
1. The GPSeye IN1 must be fixed installed. It must not be given to a person for the
free use outside of the vehicle since in this case you would have an illegal person
tracking.
2. The GPSeye IN1 may only send during the individual working time. Corresponding
settings can be made by the GPSoverIP GmbH.
3. The driver must be taught about the installation and sign a declaration of consent.
You find this consent declaration as template on the supplied CD-ROM.
4. A general assignment of the gained driver/vehicle information is not allowed, with one
exception: during the agreed individual working time and/or the general business
hours. From reasons of data protection the name of the driver may neither in
separate lists, nor in the identification of the vehicle be used or assigned.
5. The vehicle equipped with a GPSeye IN1 must be a business vehicle, i.e. is has to
appertain to the business assets.
6. The works committee - if available - must be informed of the use of the location
technology GPSoverIP.

Our experience shows, however, that only in the case of observation of these points a
judicially acknowledged use of the gained data is possible in the German judicial system.
