Further or other claims under the manufacturer warranty
shall be excluded. IVS GmbH is not liable for the disrup-
tion of services and operation, lost profits or the loss of
data, additional software or information downloaded by the
client. The backup of this software is the client’s responsi-
bility. The exclusion of liability shall not apply in cases
where our liability is mandatory, e.g. product liability act, in
cases of deliberate intention, gross negligence, claims
based on liability for danger to human life, physical injury
or danger to health or due to violation of essential con-
tractual obligations. However, claims for the violation of
essential contractual obligations shall be limited to fore-
seeable damages that are typical for this type of contract,
provided there is no liability for danger to human life, phy-
sical injury or danger to human health or liability pursuant
to product liability law. The duration of the warranty shall
not be extended by services rendered under the terms of
the warranty.
The receipt with purchase date is valid as warranty certifi-
cate. Warranty claims must be made within two weeks
after noticing a warranty case.
